General Terms and Conditions of Sale

ARTICLE 1: APPLICATION

The present general conditions of sale govern the activity of the company HYGGE HOTELS with a capital of 3.372.000€, whose head office is located at 5 rue Lamonnoye in DIJON (21000).

They are brought to the attention of any individual or legal entity (hereafter referred to as the USER) wishing to make a purchase via the website http://www.ledefidesducs.com (hereafter referred to as “the client”) and set out the contractual provisions and conditions applicable to any reservation made on this site.

ARTICLE 2 – ACTIVITY OF THE COMPANY

The Dukes’ Challenge is a life-size escape game concept belonging to the company HYGGE HOTELS and aims at organizing and marketing investigation games in groups of 2 to 5 people.

ARTICLE 3 : ORDERS – ROOM RESERVATION

Access to HYGGE HOTELS’ facilities and services is exclusively after booking on the website http://www.ledefidesducs.com.
The reservation is made for a specific day and time and is only valid for that time slot.
The reservation is made within the limit of available seats, which are updated in real time on the website.
The reservation will only be firm and definitive after receipt by the customer of a confirmation e-mail from HYGGE HOTELS.

ARTICLE 4 – PROVISION AND USE OF THE ROOM

By the very principle of the game, HYGGE HOTELS grants USERS the right to occupy the ROOM for a maximum of 60 (sixty) minutes. The occupation of the ROOM has for one and only purpose to participate in a game organised by HYGGE HOTELS, which must be played by teams of 2 to 5 people maximum.

The USERS accept that the duration of presence in the ROOM is a maximum of 60 minutes, whether they have managed to find all the clues and solve all the puzzles or not. This point is part of the very principle of the game. At the same time, the USERS accept that the game stops before the end of the 60 minutes, especially if they have managed to find all the clues and solve all the puzzles in less than 60 minutes; without this being subject to any adjustment or compensation in terms of fees.

Admission to the ROOM is only possible upon presentation of the booking confirmation email (sent shortly after the payment process to the BUYER) and upon presentation of the BUYER’s ID.

The complexity of the game does not allow USERS under the age of 10 to participate. USERS under the age of 15 must be accompanied by an adult. Minor USERS over the age of 15 need not be accompanied by an adult. In case of doubt about the age of a USER, HYGGE HOTELS reserves the right to request proof of identity.

USERS are required to keep the ROOM and all of its equipment (non-restrictive list: decorations, furnishings etc.) in good condition and to use it in accordance with the authorised use. Therefore, the USER acknowledges to the CONTRACTOR that any damage caused intentionally or by unauthorised handling of the ROOM and its equipment will be re-invoiced.

Furthermore, the USER is obliged to use the ROOM and its equipment in such a way as not to cause or risk causing any damage to other USERS, HYGGE HOTELS premises and materials.

Throughout his presence on the premises of HYGGE HOTELS, the USER undertakes to behave in a respectable manner, to comply with the rules and to cooperate with the staff of HYGGE HOTELS. As such, HYGGE HOTELS does not tolerate any form of violence, whether verbal or physical, in the form of harassment or intimidation towards its employees and therefore reserves the right to refuse access to the premises to any person whose behaviour would be similar to the elements mentioned above.

HYGGE HOTELS also reserves the right to deny access to any person under the influence of alcohol or drugs for safety reasons for the said person and his or her entourage. For all the conditions mentioned above, the prohibition of access does not give the right to any indemnity or reimbursement.

Due to the nature of the game, no registration can be made in the ROOM. Thus, the use of video and/or audio recording devices (this includes but is not limited to: mobile phones, cameras, Go Pro) is strictly prohibited. Any use of this type of device may result in the complete stoppage of the game for the entire team.

HYGGE HOTELS expects its USERS not to disclose details of the game directly and/or indirectly. Any partial or total disclosure would violate the commercial interests of HYGGE HOTELS.

ARTICLE 5 – PRIZES

The rates indicated by HYGGE HOTELS are in euros, all taxes included, taking into account the VAT applicable on the day of the order, any change in the rate may be passed on to the price of the services.
The prices charged by HYGGE HOTELS are indicated on the WEBSITE. 

The price of a part depends on the day of the week and the number of persons:

Off-peak rate: Monday to Thursday (excluding public holidays and school holidays in the Dijon area).
– 2 persons: 60€ – 30€/persons
– 3 persons: 69€ – 23€/persons
– 4 persons: 84€ – 21€/persons
– 5 persons: 95€ – 19€/persons

Peak hour rates: Friday to Sunday + public holidays and school holidays in the Dijon area.

– 2 persons: 70€ – 35€/persons
– 3 persons: 81€ – 27€/persons
– 4 persons: 100€ – 25€/persons
– 5 persons: 115€ – 23€/persons

Any other service, such as the personalization of rooms, will be billed additionally.
HYGGE HOTELS reserves the right to modify its rates at any time. Any BUYER will pay the amount relative to the rate in force at the time of his reservation.

In accordance with article 121-21-8 of the consumer code, no reservation can be cancelled or reimbursed except in the case of a cancellation due solely to the fault of HYGGE HOTELS. In the latter case, the amount of the initial reservation will be refunded.

The HYGGE HOTELS room personalisation option requires the USER to send some elements to HYGGE HOTELS. At the time of booking, the list of necessary elements is sent to the USER. In the absence of communication of these elements three days before the date of the service, HYGGE HOTELS reserves the right not to put the personalisation option in place without this giving rise to a refund.

A reservation cannot be transferred or resold for commercial purposes. If a reservation is transferred or resold in violation of this article, the holder of the reservation will be denied access.

If USERS are late for a RESERVED SESSION, USERS may decide whether or not they wish to start the game. In any case, the ROOM must be vacated at the time specified in the initial reservation. HYGGE HOTELS reserves the right to refuse access to USERS who are 20 minutes or more late. Schedules will be systematically reminded in the confirmation emails sent by HYGGE HOTELS.

A postponement of the SESSION is possible up to 3 days before the date initially reserved by writing to HYGGE HOTELS at contact@ledefidesducs.com.

If fewer USERS show up to participate in the GAME SESSION than originally planned at the time of booking, the BUYER and/or USERS are not entitled to a refund of the difference in price.

If more USERS show up to participate in the game session than originally booked, the price difference must be paid before participating in the game, within the limit of 5 players (USERS) authorized by the ROOM.

HYGGE HOTELS reserves the right to refuse any reservation to a BUYER who has not paid for all the services that would have been invoiced to him.

For gift cards in accordance with the provisions of article L.121-21 of the French Consumer Code, in the case of distance selling, the BUYER has a 14-day retraction period if the gift voucher has not been used from the date of receipt of the gift card by the BUYER, or failing this, the Beneficiary, without having to justify the reasons, nor to pay penalties, with the exception of delivery and return costs which will remain the responsibility of the BUYER.
The Beneficiary shall inform HYGGE HOTELS of his/her decision to withdraw by sending it, before the expiry of the period provided for in article L. 121-21.

ARTICLE 6 – PERSONAL DATA

The BUYER is responsible for the accuracy of the information entered on the online reservation form on the WEBSITE.

The BUYER and/or the USER who enters his/her telephone details on the HYGGE HOTELS INTERNET SITE already accepts to be contacted by HYGGE HOTELS by telephone or SMS.

HYGGE HOTELS informs the RESERVANT of the possibility of adding his/her telephone number to the BLOCTEL opposition list (http://www.bloctel.gouv.fr/) in order to avoid any telephone canvassing.

HYGGE HOTELS undertakes not to transmit the personal data of its USERS to a company outside the HYGGE HOTELS group, except at the request of an authority authorised by law and within the framework of the legal provisions in force.

The USERS accept that their end of game photo will be published on the HYGGE HOTELS Facebook page. USERS may at any time request the removal of their photo by sending an email to contact@ledefidesducs.com.

ARTICLE 7 – SECURITY

The USER undertakes to respect all security measures given to him, whether they are contractual, displayed on site or given orally by HYGGE HOTELS staff.

It is formally and strictly forbidden to smoke inside the site.
Each USER undertakes to read and respect the safety and fire protection instructions, as well as the emergency exits. These are clearly identified in the HYGGE HOTELS premises. It is therefore strictly forbidden to obstruct the emergency exits, which must remain clear under all circumstances.
The USER may use the emergency exits if and only if the situation requires the evacuation of the premises (e.g. fire). Any abuse and/or untimely opening of these exits by one or more USERS will result in the re-invoicing of the costs caused by this abuse.

The USER is aware that it is absolutely forbidden to bring into the premises and into the ROOM objects considered to be (1) physically hazardous (explosive, flammable, oxidizing, pressurized or liquefied gas, corrosive), (2) hazardous to health (toxic, corrosive to the skin, irritant/sensitizer, carcinogen/teratogen) and (3) hazardous to the aquatic environment.

ARTICLE 8 – PHOTOS AND CAMERAS

Pictures of each USER team can be taken before or after the game session. These photos can be used by HYGGE HOTELS to feed its WEBSITE or its digital ecosystem (Examples without restriction, Facebook, Twitter, Instagram etc.). These same photos will be sent by email to the USERS within a reasonable period of time after the game session.
HYGGE HOTELS cannot be held responsible for the use that will be made of the photos by the USERS and/or the BUYER.

Each ROOM is equipped with a video surveillance and listening device allowing HYGGE HOTELS staff to follow the game session and to refer USERS if necessary. This device only contributes to the game and does not record the USERS’ GAME SESSIONS in any way.

ARTICLE 9 – OWNERSHIP

All the elements, texts, blanks, images of the site http://www.ledefidesducs.com are the exclusive property of HYGGE HOTELS.
Any reproduction is strictly forbidden.

ARTICLE 10 – COMPETENT COURTS

These terms and conditions and any contract concluded incorporating these terms and conditions are governed by French law and all disputes are subject to the exclusive jurisdiction of the French courts.

In accordance with the order n°2015-1033 of 20 August 2015 and the implementing decree n°2015-1382 of 30 October 2015, any dispute or litigation known as a consumer dispute, subject to Article L.152-2 of the Consumer Code, may be subject to amicable settlement by mediation with the MTV.Travel – Médiation Tourisme et Voyage.
To submit your dispute to the mediator, you can, at your choice :
– Fill in the form on the MTV.Travel website at http://www.mtv.travel/index.php?page=saisine-du-mediateur – Send your request by ordinary or registered mail to MTV Médiation Tourisme Voyage – BP 80 303 – 75 823 Paris Cedex 17 – France.

Whatever the means used to enter the MTV.Travel, your request must contain the following elements in order to be processed quickly: Your postal, email and telephone details as well as the full name and address of HYGGE HOTELS a brief statement of the facts, and proof of the preliminary steps taken with the company HYGGE HOTELS.
